The Service
Apex provides AI coaching and analysis, customer relationship management, communications and messaging tools, website and funnel generation, and related business services for real estate professionals. Features may change, expand, or be discontinued over time.
Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.
Acceptable Use
You agree not to use Apex to send unlawful, harassing, deceptive, or unsolicited messages, to violate any applicable law including the Telephone Consumer Protection Act (TCPA) and CAN-SPAM, or to infringe the rights of others. You are responsible for obtaining valid consent from any individual you contact through the platform.
SMS and Text Messaging
By providing your phone number and opting in, you consent to receive appointment, account, and support text messages from Apex. Message and data rates may apply. Message frequency may vary. Reply STOP to opt out at any time, or HELP for help. We do not sell or share your mobile phone number or SMS opt-in data with third parties or affiliates for marketing or promotional purposes. Your use of our messaging features must comply with all applicable laws and carrier requirements.
Payment and Billing
Fees for paid plans are billed in advance and are non-refundable except where required by law. You authorize us to charge your provided payment method for all applicable fees.
Intellectual Property
Apex and its software, design, and content are owned by Apex Operating Systems Inc and protected by intellectual property laws. Content you provide remains yours; you grant us a license to use it solely to provide the service.
Third-Party Services
Apex integrates with trusted third-party service providers for core functionality. Each provider operates under its own terms and privacy commitments, and your use of those features may be subject to their terms.

Apex is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee specific business results, lead volume, or revenue outcomes.
Limitation of Liability
To the maximum extent permitted by law, Apex Operating Systems Inc shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss of profits or data, arising from your use of the service.
Termination
We may suspend or terminate your access for violation of these Terms. You may cancel at any time. Upon termination, your right to use the service ends, and data is handled as described in our Privacy Policy.
Changes to These Terms
We may update these Terms from time to time. Continued use after changes take effect constitutes acceptance of the revised Terms.
Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
